1Acceptance of terms

These Terms of Use ("Terms") govern your access to and use of the Brand My Email website, our Email Signature Care™ service, and related products including eLetterhead™, eBusinesscard™, ePostcard™, and SigFlex™ (collectively, the "Services"), operated by Brand My Email, Inc. ("Brand My Email," "we," "us," or "our").

By accessing our website, requesting a demo, or subscribing to the Services, you agree to be bound by these Terms. If you are using the Services on behalf of a company or organization, you represent that you have the authority to bind that organization to these Terms.

2Description of services

Brand My Email designs, deploys, and manages branded email signatures for organizations, including full-screen "eLetterhead" signatures, compact "eBusinesscard" signatures, and ongoing maintenance, updates, and support under our Email Signature Care™ plan. Specific features, pricing, and deliverables are described on our website and may be confirmed separately in a proposal, order form, or client agreement.

3Accounts & eligibility

You must be at least 18 years old and able to form a binding contract to use the Services. You are responsible for maintaining the confidentiality of any login credentials associated with your account and for all activity that occurs under your account.

4Acceptable use

You agree not to use the Services to:

• Violate any applicable law or regulation;
• Infringe the intellectual property or other rights of any third party;
• Transmit malicious code, spam, or unsolicited bulk communications;
• Impersonate any person or entity, or misrepresent your affiliation with one; or
• Interfere with or disrupt the integrity or performance of the Services.

5Billing & cancellation

Email Signature Care™ is billed on a monthly or annual basis as selected at signup, in addition to a one-time design & setup fee for your initial signature suite. Monthly plans may be cancelled at any time, effective at the end of the current billing period; annual plans run through their full term. When a plan ends, the associated signature software stops functioning as described on our pricing page.

6Intellectual property

The Brand My Email name, logo, and the trademarks Promotional Email Signatures™, eLetterhead™, ePostcard™, eBusinesscard™, and SigFlex™ are the property of Brand My Email. Signature designs created for you are licensed for your organization's use for as long as your Email Signature Care™ subscription remains active, as further described in your order form or client agreement.

7Third-party services & trademarks

Our website may reference or display sample work created for organizations that use third-party trademarks or brand names for identification purposes only. Such references do not imply endorsement by, or affiliation with, the trademark owner unless explicitly stated. Brand My Email is an independent vendor.

8Disclaimers & limitation of liability

The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied. To the fullest extent permitted by law, Brand My Email will not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of the Services.

9Termination

We may suspend or terminate access to the Services if we reasonably believe these Terms have been violated. You may stop using the Services, and cancel your subscription, at any time as described in Section 5.

10Changes to these terms

We may update these Terms from time to time. Material changes will be reflected by an updated "Last updated" date at the top of this page. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
